Puppy Purchase Agreement

This Puppy Purchase Agreement (“Agreement”) is entered into by and between the undersigned buyer (“Buyer”) and breeder (“Breeder”) for the reservation and eventual sale of a puppy. By submitting a deposit, Buyer agrees to the following terms and conditions:

1. Non-Refundable Deposit

   Buyer acknowledges and agrees that a deposit is required to reserve a puppy and that such deposit is non-refundable under all circumstances, except as expressly provided in this Agreement. This includes, but is not limited to, situations where the Buyer changes their mind, becomes unable to care for the puppy, or otherwise chooses not to proceed with the purchase. Upon receipt of the deposit, Breeder agrees to hold the puppy until it is weaned and ready for pickup, typically at eight (8) weeks of age.

2. Payment of Deposit

   The deposit shall be paid to Breeder via Venmo at the account handle @Mt-Labradors (last 4 digits of the phone number: 4079).

3. Reservation and Acknowledgements

   Buyer acknowledges that:

   • Litter sizes vary and cannot be controlled or guaranteed by the Breeder.

   • Wait times for a puppy may be longer than anticipated.

   • The deposit secures a reservation or “spot” for a puppy but does not guarantee availability of specific preferences (such as color, gender, or temperament).

   • The Breeder makes no guarantees regarding the future traits, health, or characteristics of the puppy once it reaches adulthood.

    

4. Preference-Based Refund or Transfer

   If a puppy matching the Buyer’s specified preferences is not available in the litter, the Buyer may choose to either:

   (a) transfer the deposit to a future litter, or

   (b) receive a full refund of the deposit.

5. Discretionary Refunds

   If Buyer voluntarily decides not to proceed with the purchase for any reason other than those stated in Section 4, the deposit remains non-refundable. However, if the Breeder is able to resell the reserved puppy to another buyer within a reasonable time, the Breeder may, at their sole discretion, refund the deposit to the original Buyer.

6. Final Purchase Price and Payment Terms

   The deposit will be credited toward the final purchase price of the puppy. The remaining balance must be paid in full before the puppy is delivered or ownership is transferred. Final price does not include transportation, shipping, or delivery charges, which shall be the responsibility of the Buyer.

7. Breeding Contingencies

   If a planned breeding does not result in a litter, or if the desired pick puppy (based on the Buyer’s preferences) is not born, Buyer may transfer the deposit once to another planned breeding. If the second breeding also fails to produce a matching puppy, Buyer is entitled to a full refund of the deposit.

8. Governing Law

   This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of laws provisions.
